Brian: Thank you. You were speaking to a buyer earlier. I was just calling for clarification. Not a buyer, I’m sorry, I’m a realtor. You were speaking to a caller about liens on their home.
Attorney Tom Olsen: Right.
Brian: And you were talking about how the home is protected from creditors?
Attorney Tom Olsen: Yes.
Brian: Does that require homestead exemption or do you just have to prove that you live there?
Attorney Tom Olsen: Okay. So, our Florida Constitution says that the home you live in, your homestead is absolutely protected from creditor claims. The other homestead exemption that you’re familiar with is the one that you apply to your county tax collector’s office that if they grant you homestead exemption, then they will knock ,000 off the value of your real estate every year. They do not necessarily go hand in hand. So in theory, you could not have homestead for your real estate tax purposes, but still have homestead under the Florida Constitution. But most people have both. Brian, does that answer your question for you?
Brian: Yes, it does.
Attorney Tom Olsen: Okay. Very good.
Attorney Tom Olsen: So Brian, here’s one example, for example. If you moved into a new home today, well you’re not going to get homestead exemption for real estate tax purposes until 2014. So, it maybe you’ve homestead today for Constitutional protection from creditor claims, for real estate tax purposes that does not happen until 2014.
