Attorney Tom Olsen: All right, let’s go to work. First in line this Saturday morning is Cheryl from Orlando. Cheryl, you’re on News Talk WDBO. Go ahead.
Cheryl: Good morning. We went through bankruptcy a couple of years ago, and now we are trying to refinance our house through the Heart Program, and the title search revealed a lien from a water treatment softener company on our house. Can I still do that after the bankruptcy?
Attorney Tom Olsen: First of all, sometimes when you have work done on your home, like new windows, or, what did you have done, I’m sorry, again?
Cheryl: It was a water softener.
Attorney Tom Olsen: Okay, they will actually put a mortgage lien against your house, a voluntary lien that you signed a piece of paper agreeing that they have a lien against your house. Is that what you think you did for this water softener?
Cheryl: I don’t think so.
Attorney Tom Olsen: Okay. So the other type of lien is that you did not pay them and they sued you, and they got a judgment against you. So I think that’s where the distinction is going to lie, Cheryl. If they actually sued you and got a judgment against you prior to your bankruptcy, then that judgment should not be a lien against your property.
If, when you had that work done, you signed a piece of paper, and said, “Yes, water softener company, you have a mortgage lien against my house by doing this work,” then that is still a mortgage lien against your house.
And so the title company’s doing a title search, and they’re telling you there’s a lien, next step is, get a copy of that lien, Cheryl.
Cheryl: Okay. Can I find that online through the — the property appraiser’s site or–
Attorney Tom Olsen: Okay, are you in Orange County, Cheryl?
Attorney Tom Olsen: So what you would google, not property appraiser’s website, that’s a great website for getting tax information about your house, but you’re going to google Orange County Comptroller. It is through the Orange County Comptroller’s office where you find copies of recorded documents, mortgages, liens, et cetera. Orange County Comptroller’s office.
